Five Atmore residents are taking the City of Atmore to court over flooding in their community.
Clifford E. Reeves, Shirley A. Reeves, Joe Harris (dec.), Mary Townson, Ted Sanders and Mary Sanders are claiming compensatory and punitive damages and court costs.
They charge that the city has failed to construct and/or maintain the drainage system surrounding or in the immediate vicinity of their residences.
They allege that the city has demonstrated negligence and wantoness in their actions and has failed to abate the nuisance.
The plaintiffs own property at 408 S. Presley St., 402 S. Presley St., 207 School St., and 401 Roberts St. They claim their personal residences were flooded on or about Feb. 7, 1998; March 16, 1998; April 17, 1998; and July 29, 1998.
The plaintiffs claim the failure of the city to provide an adequate drainage system has caused them to suffer mental anguish and has "caused hurt, inconvenience and damage to the Plaintiffs' interest in, use and enjoyment of their personal residence."
The civil suit was filed in August 1998. Jury selection is set for Monday, Jan. 29.
The plaintiffs are represented by Max Cassady, Evergreen. The city is represented by Larry Wettermark, Mobile.
