Maxwell Street resident Regina Fry will have to find another home for her horses following a decision made by the Atmore City Council Monday afternoon.
Fry approached the council asking that she be allowed to keep her horses on her property at the corner of Maxwell and May streets.
Fry also presented the council with a signed petition from her neighbors stating that the horses are “not a problem to them.”
According to Section 5-2 of the city’s code of ordinances provided by Lowery, owners of horses residing in the city or its police jurisdiction may keep or harbor not more than two horses in a pen, barn or other like enclosure, provided such pen, barn or other enclosure is not nearer than 200 feet to any dwelling house, other than that of that owner or custodian of such horses, and not nearer than 200 feet to any church, school or other building that is frequented by the public. The ordinance goes on to read that the places the horses are kept are to be kept clean and in a satisfactory sanitary condition.
Even though the city’s ordinance allows such animals in the city limits, Lowery said that once a citizen of the community makes a complaint regarding the animal being a nuisance, the complaint takes precedence. Lowery added that there was more than one complaint regarding the horses. Fry was under the impression that there was only one complaint.
In other business, the council:
Two additional companies bid on the tractor including Hendrix Tractor in the amount of $18,633 and Drew Tractor, Inc. in the amount of $18,900, plus $2,190 for a rotary cutter.
The accepted bid is pending bid specification confirmation.
