An Atmore man has been indicted for reckless murder of his brother in May’s “stand your ground” shooting in McCullough.

Atmore Advance archives show the incident occurred on May 6 at James “Jamie” Tolin Scott’s Jefferson Avenue home. Scott is accused of fatally shooting his brother, Tony Tolin Scott, with a small caliber rifle. Records also show Escambia County Sheriff’s deputies had previously responded to other physical altercations between the brothers at the home.

Chief Deputy Mike Lambert said Monday Scott was indicted earlier this month by an Escambia County grand jury following the department’s investigation.

“After the incident occurred and further investigation, the case was presented to the grand jury, who after hearing the case, elected to indict Mr. Scott for reckless murder,” Lambert said.

Scott was booked into the Escambia County Detention Center, where he remains under a $250,000 bond.
