Officer Lee Fountain was performing a motorist assist on the highway just north of Jefferson Davis Community College’s Atmore campus when a truck traveling south on the highway struck his patrol car and then hit Fountain, sending him about 40 feet to the side of the road, according to the statement. It was raining at the time of the incident.

Fountain was transported to Atmore Community Hospital before being transferred to USA Medical Center.

According to Tribal Police Chief Larry Hammonds, Chester Presley was taken into custody on the scene. He was charged with DUI and felony assault, according to the statement.

Fountain was released from USA over the weekend and is currently on medical leave.

Fountain’s wife, Jordan, said he is recovering, but is in “a lot of pain” and unable to walk without assistance.

“He is so appreciative to those who have showed support since the incident,” Jordan Fountain said. “He is doing well and feels better with each day. He is so thankful that the situation wasn’t any worse than it could have been. He is looking forward to a full recovery and ready to get back to work.”
